ESB to appeal court ruling over flooding damage

The Commercial Court ruled earlier this week that the ESB were 60% liable for flooding damage to UCC in 2009.

The ESB is expected to appeal a ruling by a commercial court this week which found it 60% liable for damage to a Cork college during the 2009 floods.

The state agency has confirmed it's considering whether there are grounds to appeal with many householders, businesses and even a hospital examining further flood claims in light of the judgement.

University College Cork on behalf of its insurer Aviva made claims in relation to the ESB's operation of two of its dams on the River Lee which they say resulted in significant damage to many of their buildings.

The ESB however claimed that they have no duty to manage flood flow and that having no dams, could have resulted in a higher peak water flow.    

Speaking to RedFM News spokesman for the Mardyke residents Barry Keane says many householders will now have confidence to take a case as some are still dealing with the aftermath of the floods.
