Gardai Prepare File For DPP Following Release Of Man Involved In Fatal Cork Shooting

Gardai are to prepare a file for the DPP after last night releasing without charge a 44 year old man arrested for questioning about the fatal shooting of a man in the city last month.
Detectives arrested the man in Ballyphehane at around 10.30am yesterday and brought him to Togher Garda Station for questioning about the death of Diarmuid Byrne.
The 41-year-old died instantly after he suffered a fatal gunshot wound to the head while with a friend in an upstairs room of his house at Plunkett Road in Ballyphehane on April 26th last.
The friend was deeply traumatised but explained to gardai he had discharged Diarmuid Byrne's legally held shotgun without realising the weapon was loaded and had accidentally shot his friend.
The arrest of the 44-year-old follows an investigation and the results of ballistics tests on the shotgun.
The man was held until close til midnight last night when he was released without charge and gardai will now prepare a file on the matter for the DPP.
